This agreement sets out the rules for reserving a Doberman puppy offered on the dobermanszczeniaki.pl website. You enter into it when you reserve a puppy and pay the reservation amount.
§ 1. Parties to the agreement
- Seller: JAGBAR Bartosz Jagła, a sole trader registered in the Central Registration and Information on Business (CEIDG), Byszewy 26D, 92-701 Byszewy, NIP 7282881095, REGON 527535523, e-mail: dobermanszczeniaki@gmail.com, phone and WhatsApp: +48 533 886 972, hereinafter the "Seller".
- Buyer: the person who made the reservation and whose details (first name and surname, address, e-mail address and phone number) were entered in the reservation form on the Website or given to the Seller when reserving via WhatsApp, hereinafter the "Buyer".
§ 2. Subject of the agreement
- The subject of the agreement is the reservation of a Doberman puppy indicated at the time of reservation, identified on the Website by its working name, sex and date of birth (23 August 2026), hereinafter the "Puppy".
- From the moment the agreement is concluded, the Seller does not offer the Puppy to other persons and does not enter into agreements concerning it with other persons.
- This agreement is a preliminary agreement within the meaning of Article 389 of the Civil Code. The parties undertake to conclude a sale agreement for the Puppy on the day of its delivery, on the conditions set out in that agreement.
- The Puppy is microchipped and has an Export Pedigree FCI/KSS. The Seller hands over the Puppy's documents to the Buyer on delivery. The Puppy's identification details, including the chip number, will be entered in the sale agreement.
- Descriptions, photos and videos published on the Website, including the entries in the diary "Carer's notes", are for information only and describe the Puppy's behaviour at the time of publication. Some of the photos and videos on the Website come from photo banks and do not show the Puppy.
§ 3. Conclusion of the agreement
- Reservation on the Website. The Buyer fills in the reservation form, reviews the Terms of Service and this agreement, accepts them and pays the reservation amount online. Payments are handled by Stripe. The agreement is concluded when the payment operator confirms the payment.
- Block during payment. Once you proceed to payment, the Puppy is blocked for the Buyer for 30 minutes, and during this time no one else can reserve it. If the payment is not completed, the block expires and the agreement is not concluded.
- Reservation via WhatsApp. The Seller sends the Buyer the text of the Terms of Service and this agreement before payment. The Buyer confirms in a message that they accept them and pays the reservation amount by bank transfer, by BLIK to a phone number, or by payment on the Website. The agreement is concluded when the reservation amount reaches the Seller or the payment operator confirms the payment.
- After the agreement is concluded, the Seller sends the Buyer, to their e-mail address, a confirmation of the reservation together with the accepted version of this agreement and the Terms of Service, in a form that allows them to be saved and kept.
- If two payments are received for the same Puppy, for example if one of them is confirmed after the block has expired, the agreement is concluded with the person whose payment was confirmed first. The Seller contacts the other person within 24 hours and refunds the full amount paid within 14 days. With that person's consent, the Seller may, instead of a refund, offer a reservation of another available puppy.
§ 4. Price and payments
- The price of the Puppy is €10,000. This is the total price.
- The reservation amount is €3,000. It is a part payment and is credited toward the price.
- The remaining part of the price, €7,000, the Buyer pays on delivery, before the Puppy is handed over, in a manner agreed by the parties.
- The Seller refunds money in the cases described in this agreement using the same payment method the Buyer used, unless the Buyer agrees to another method. The refund is free of charge for the Buyer.
§ 5. Arrival and delivery of the Puppy
- The planned date of the Puppy's arrival in Poland is the beginning of December 2026.
- The Seller delivers the Puppy to the address given by the Buyer. The Seller gives the Buyer the date and time of delivery by e-mail or by phone at least 7 days before delivery.
- If the Buyer cannot receive the Puppy on the scheduled day, the parties set another date, no later than 14 days after the original date. Until the day of delivery, the Seller ensures care for the Puppy.
- On delivery the parties conclude the sale agreement, the Buyer pays the remaining part of the price, and the Seller hands over the Puppy together with the documents.
- If the Puppy's arrival is delayed, the Seller informs the Buyer of this without delay. If delivery is not possible by 31 December 2026, the Buyer may withdraw from the agreement and receive a refund of the full reservation amount within 14 days, or agree to a new date.
§ 6. Right of withdrawal from the agreement
- A Buyer who is a consumer may withdraw from this agreement within 14 days from the date of its conclusion, without giving a reason and without incurring costs.
- To withdraw from the agreement, it is enough to send the Seller a clear statement, for example by e-mail to dobermanszczeniaki@gmail.com or by letter to the Seller's address. You may use the withdrawal form template in Annex No. 2, but this is not mandatory. To keep the deadline, it is enough to send the statement before it expires.
- The Seller refunds the reservation amount without undue delay, and no later than 14 days from receiving the statement, in accordance with § 4 paragraph 4.
- The provisions of this paragraph concerning consumers also apply to a natural person entering into an agreement directly connected with their business activity, where the agreement shows that it does not have a professional character for that person.
- If the Puppy's sale agreement is concluded at a distance or outside the Seller's business premises, the Buyer who is a consumer also has the statutory right to withdraw from the sale agreement within 14 days from the day the Puppy is taken into their possession, on the terms set out in the Consumer Rights Act of 30 May 2014.
- The notice on the right of withdrawal is Annex No. 1.
§ 7. When delivery does not take place
- For reasons attributable to the Seller, for example if the Seller does not hand over the Puppy on the agreed date: the Buyer may withdraw from the agreement, and the Seller refunds the full reservation amount within 14 days of receiving the statement. The Buyer may claim compensation for damage on general terms.
- Without fault of either party, if handing over the Puppy becomes impossible for reasons for which neither party is responsible, for example due to an accidental event or force majeure: the agreement expires, and the Seller refunds the full reservation amount to the Buyer within 14 days from the day on which the Seller informs the Buyer of this. With the Buyer's consent, the Seller may, instead of a refund, offer a reservation of another available puppy. In that case, the amount paid is credited toward the price of that puppy.
- For reasons attributable to the Buyer, when after the deadline in § 6 paragraph 1 the Buyer gives up the purchase, or does not receive the Puppy despite a reminder and the setting of an additional deadline of at least 7 days: the Seller may withdraw from the agreement and offer the Puppy to other persons. The Seller refunds the reservation amount to the Buyer within 14 days. The Seller may claim compensation for damage on general terms, in particular for documented costs of keeping the Puppy after the set delivery deadline. Deducting these costs from the refund requires the Buyer's consent.
§ 8. Complaints
- Complaints about the reservation may be submitted by e-mail to dobermanszczeniaki@gmail.com or by letter to the Seller's address. It is helpful to describe the subject of the complaint and to give the reservation number.
- The Seller responds to a complaint within 14 days of receiving it, to the Buyer's e-mail address or in another way indicated by the Buyer.
- The Seller's liability for the Puppy's conformity with the sale agreement is governed by law, in particular the Consumer Rights Act, and by the sale agreement.
§ 9. Personal data
The Seller processes the Buyer's personal data for the purpose of concluding and performing this agreement. Details are described in the Privacy Policy.
§ 10. Final provisions
- Amendments to this agreement require the consent of both parties expressed at least in documentary form, for example by e-mail.
- This agreement is governed by Polish law. Nothing in this agreement limits the rights that a consumer has under the provisions of law.
- The parties shall try to resolve disputes amicably. A consumer may use free help from the municipal or county consumer ombudsman, or mediation conducted by the voivodeship office of the Trade Inspection (Inspekcja Handlowa). Disputes are settled by the court with jurisdiction under the Code of Civil Procedure.
- Matters not regulated in this agreement are governed by the provisions of the Civil Code and the Consumer Rights Act.
Annex No. 1. Notice on the right of withdrawal from the agreement
Right of withdrawal from the agreement
You have the right to withdraw from the reservation agreement within 14 days, without giving any reason.
The period for withdrawal from the agreement expires 14 days after the date of its conclusion.
To exercise the right of withdrawal from the agreement, you must inform us (JAGBAR Bartosz Jagła, Byszewy 26D, 92-701 Byszewy, e-mail: dobermanszczeniaki@gmail.com, phone: +48 533 886 972) of your decision to withdraw from the agreement by means of a clear statement, for example a letter sent by post or by e-mail.
You may use the withdrawal form template in Annex No. 2, but this is not mandatory.
To keep the withdrawal deadline, it is enough that you send the information about exercising your right of withdrawal before the withdrawal period expires.
Consequences of withdrawal from the agreement
If you withdraw from the agreement, we will refund all payments received from you without undue delay, and in any case no later than 14 days from the day on which we were informed of your decision to exercise the right of withdrawal. We will make the refund using the same payment method you used in the original transaction, unless you have expressly agreed to another arrangement. In any case, you will not bear any fees in connection with this refund.
